الحماية القانونية للأطفال اللاجئين في الجزائر

Résumé: الملخص: تهدف هذه الدراسة إلى إبراز فعالية الآليات المعنية بكفالة حماية الأطفال اللاجئين في القانون الجزائري من خلال استقراء أهم النصوص القانونية المتعلقة بذلك، فالاهتمام بهذه الفئة جاء ضمن نصوص قانونية متفرقة تنص على جملة من الضمانات التي يستفيد منها الأطفال اللاجئون والقابلة للتطبيق، بدءا بالمرسوم رقم 63/274 الذي يحدد طرق تطبيق الاتفاقية الدولية الخاصة بوضع اللاجئين لعام 1951، والقانون رقم 08/11 المتعلق بشروط دخول الأجانب إلى الجزائر وإقامتهم بها وتنقلهم فيها، إضافة إلى قانون حماية الطفل رقم 15/11، والقانون 20/05 المتعلق بالوقاية من التمييز وخطاب الكراهية، لنخلص بنتيجة أن الطفل اللاجئ في الجزائر يتمتع بكل الحقوق المنصوص عليها في اتفاقية حقوق الطفل والاتفاقيات ذات الصلة المصدق عليها من طرف الجزائر سواء الدولية أو الإقليمية، إضافة لتمتعهم بحقوق الطفل المنصوص عليها في التشريع الوطني. Summary: This study aims to highlight the effectiveness of the mechanisms concerned with ensuring the protection of refugee children in Algerian law by extrapolating some of the important legal texts related to this. The interest in this category came within various legal texts that stipulate a set of guarantees that refugee children benefit from and are applicable, starting with Decree No 63 /274, which specifies the methods of implementing the International Convention relating to the Status of Refugees of 1951, and Law No. 08/11 relating to the conditions for the entry, residence and movement of foreigners in Algeria, in addition to Child Protection Law No. 15/11, and Law No. 20/05 relating to the prevention of discrimination and hate speech. Let us conclude that the refugee child in Algeria enjoys all the rights stipulated in the Convention on the Rights of the Child and the relevant agreements ratified by Algeria, whether international or regional, in addition to their enjoyment of the rights of the child stipulated in national legislation. Résumé : Cette étude vise à mettre en évidence l'efficacité des mécanismes visant à assurer la protection des enfants réfugiés dans le droit algérien en extrapolant les textes juridiques les plus importants y afférents. L'intérêt de cette catégorie s'est manifesté au sein de divers textes juridiques qui prévoient un ensemble de garanties. dont bénéficient et sont applicables les enfants réfugiés, à savoir le décret n° 63/274, qui précise les modalités d'application de la Convention internationale relative au statut des réfugiés de 1951, loi n°08/11 relative aux conditions d'entrée, de séjour et de circulation des étrangers en Algérie, la loi n° 15/11 relative à la protection de l'enfance, et la loi n° 20/05 relative à la prévention des discriminations et des discours de haine. Concluons que l'enfant réfugié en Algérie bénéficie de tous les droits stipulés dans la Convention relative aux droits de l'enfant et les accords pertinents ratifiés par l'Algérie, qu'ils soient internationaux ou régionaux, ainsi que la jouissance des droits de l'enfant stipulés dans la législation nationale.
