تفعيل نظام الوضع تحت المراقبة الالكترونية بالسوار الالكتروني( دراسة على ضوء القانون 01/18 المعدل والمتمم)

Résumé: من خلال هذه الدراسة تم تسليط الضوء على نظام الوضع تحت المراقبة الالكترونية بالسوار الالكتروني، باعتبارها إجراء بديل للعقوبات السالبة للحرية ، ونظرا للمساوئ والانتقادات التي سجلها التطبيق العملي للسجن ،تم استحداث هذا النظام بموجب القانون رقم 18-01 الذي يرسم لنا الصورة أو الإطار القانوني لهذا النظام، حيث يبين لنا خصائص وشروط وإجراءات تطبيق هذا النظام. لنبين بعدها فاعلية نظام الوضع تحت المراقبة الالكترونية بالسوار الالكتروني في تحقيق أغراض العقوبات السالبة للحرية، والتي تتجسد أساسا في إصلاح وتأهيل المحكوم عليهم، أو من خلال معرفة إيجابيات وسلبيات هذا النظام التي أولاها لنا التطبيق العملي له في العديد من التجارب This study sheds light on the electronic probation system with the Electronic Bracelet as it’s considered an alternative procedure for the custodial sentences Since the operational application of presentment has faced harsh criticism for its disadvantages, this system has been introduced hereby the ordinance number 18-01, which demonstrates for us this system’s legal framework; it shows us the features, conditions, and procedures of this system. After that, the effectiveness if the electronic probation system with the Electronic Bracelet in achieving the custodial sentences purposes, which are mainly figured out in reforming and rehabilitating the sentenced persons, or through the knowing this system pros and cons of the operational application in several experiments.
