Résumé: ملخص تناولت الدراسة موضوع تغير أراء المجتهدين في ما يسوغ فيه الاجتهاد، وعدولهم عن الأقوال الرّاجحة إلى الأقوال المرجوحة، حيث تهدف إلى بيان مفهوم القول المشهور في المذهب المالكي والأسباب التي تدفع المجتهدين إلى الأخذ بالقول الضعيف وترك العمل بالقول المشهور، وتتمثل أهمية الدراسة في كونها تبين أن الحكم على القول بالضعف لا يعني إهماله مطلقا بل قد يلجأ إليه المجتهد إذا اقتضى الامر ذلك، و هذا ما توصلت إليه الدراسة أي أن العمل بالقول الضعيف ممكن إذا توفرت الدواعي والأسباب الموجبة لذلك. Abstract: The study dealt with the subject of changing the opinions of the mujtahids in what is justified in ijtihad, and their abandonment of the preponderant sayings to the preferred ones, as it aims to clarify the concept of the well-known saying in the Maliki school and the reasons that motivate the mujtahids to adopt the weak saying and leave the work with the famous saying, and the importance of the study is that it shows that Judging a weak saying does not mean ignoring it at all, but the mujtahid may resort to it if necessary, and this is what the study concluded, meaning that working with the weak saying is possible if the reasons and reasons for that are available.reasons and reasons for that are available.
