قواعد النّسب الفقهيّة؛ جمعاً ودراسة

Résumé: ملخص هذه الدّراسة تتناول جُملة من المعاني الكليّة الضّابطة للنّسب ومُتعلّقاته من جهة المفهوم والوسائل المثبتة له والآثار المترتّبة على ثُبوته، وطرق حمايته والمحافظة عليه، وتوسّلنا في سبيل بلوغ مُرادنا بالمنهج الاستقرائيّ في تجميع المادّة العلميّة من مُدوّنات الفقه الإسلاميّ، وبالمنهج التّحليليّ في الإفادة من تلك المادّة والتّطبيق لها بما يُبيّن معناها؛ وتوصّلنا إلى جُملة من النّتائج أهمّها: 1ـ أنّ الحفاظ على النّسب أمرٌ مقصودٌ للشّارع بالأصالة والتّبع. 2ـ أنّ النّسب إذا ثبت ولو مُخالفاً للواقع؛ لم يجز لأحد أن يطعن فيه لأيّ سبب من الأسباب إلا عن طريق اللّعان. 3ـ أنّ الشّارع يتشوّف لإثبات النّسب والمحافظة عليه أكثر من نفيه. 4ـ أنّ وسائل إثبات النّسب مُعلّلةٌ وليست تعبديّة، وذلك يفتح الباب واسعاً أمام الاجتهاد القضائيّ من أجل الإفادة من كلّ الوسائل المعاصرة التي يُمكن اعتبارُها أدلّة في إثبات النّسب أو نفيه. Abstract This study examines a comprehensive set of overarching concepts governing lineage and its related matters from the perspective of its definition, the means used to prove it, the consequences of its establishment, the methods of its protection and preservation, moreover, the study applies these principles to some contemporary Islamic jurisprudential issues (Fiqh). To achieve our objective, we employed an inductive approach to gather scholarly material from Islamic jurisprudence texts, and through the analytical approach to extract the essence of this material and apply it to elucidate its significance. Our findings led us to several conclusions, the most significant of which is that: 1. The preservation of lineage is a fundamental objective of Islamic law (Shari'ah), both intrinsically and incidentally. 2. Once lineage is established, even if it contradicts reality, no one is permitted to challenge it for any reason except through the Islamic legal procedure of (li'an) Oath of condemnation. 3. Islamic law (Shari'ah) is more inclined towards establishing and preserving lineage than negating it. 4. The means of establishing lineage are based on rational considerations and not merely on religious injunctions, thus opening the door for judicial interpretation to utilize contemporary means that can be considered as evidence in establishing or negating lineage.
