تطهير العقار المرهون رهنا رسميا طبقا لأحكام القانون المدني الجزائري -the Purge Of Mortgage In Accordance With Algerian Civil Law-

Résumé: منح القانون المدني الجزائري لحائز العقار المرهون رهنا رسميا مجموعة خيارات لمواجهة تتبع الدائنين المرتهنين، من بينها أن يعرض عليهم ما يمثل قيمة العقار مقابل تطهير العقار من الرهون التي تثقله بغض النظر عن آجال الديون. ويترتب على هذا العرض احتمالان: إما أن يتم قبوله من الدائنين المرتهنين فيدفع لهم الحائز المبلغ المحدد في عرض التطهير ويتم اقتسامه فيما بينهم، وإما أن يرفض الدائنون المرتهنون طلب التطهير فيتم بيع العقار المرهون بالمزاد العلني. فإذا رسا المزاد على الحائز فإن الملكية تستقر له دون أن يحتاج إلى شهر حكم رسو المزاد، أما إذا رسا المزاد على غير الحائز فإن الملكية تنتقل إلى المالك الجديد بموجب شهر الحكم برسو المزاد. ويكون للحائز الرجوع بالتعويض على المالك الأصلي. Abstract: The Algerian Civil Code granted the holder of mortgaged property a set of options to deal with the tracking of creditors, including offering them the value of the property in exchange for purge the property from the mortgages without paying attention to the date of debt repayment. This offer entails two possibilities: either to be accepted by the creditors, the holder will pay them the specified amount and they will be to divide it. Or creditors refuse to request purging then the property will be auctioned. If the auction is docking of the holder, the property will settle for him without the need for real estate, In the case of docking auction for another person the property is transferred by real estate of the judgment of docking auction.Then the holder can be request original proprietor for a compensation.
