تنفيذ الأحكام الأجنبية في الجزائر – دراسة مقارنة-

Résumé: الملخص (بالعربية) : يعد موضوع تنفيذ الأحكام الأجنبية أحد أهم موضوعات القانون الدولي الخاص، فالمبتغى من تخصيص قواعد هذا الفرع من القانون تسوية النزاعات بين أفراد العلاقات الدولية الخاصة وتمكينهم من حكم سواء أكان قضائيا أو تحكيميا، و لا جدوى من هذا الحكم إذا لم يسمح بتنفيذه خارج دولة إصداره، لذا فكرت أغلب تشريعات العالم في ضرورة الاعتراف بآثار هذه الأحكام خارج إقليم دولة إصدارها حفاظا على مصالح الأفراد. غير أنها لم تجز تنفيذها إلا وفقا لشروط خاصة ورد تنظيمها في الاتفاقيات وكذا القوانين الداخلية. وعلى غرار التشريعات المقارنة نظم المشرع الجزائري موضوع تنفيذ الأحكام الأجنبية الصادرة بالخارج سواء أكانت قضائية أو تحكيمية عن طريق الاتفاقيات الدولية و الثنائية، وكذا قانون الإجراءات المدنية و الإدارية إلا أن هذا الأخير لم يجد ضبط هذا الموضوع . الكلمات المفتاحية: الحكم الأجنبي- الحكم القضائي الأجنبي-حكم التحكيم الأجنبي- الأمر بالتنفيذ-القانون الجزائري- القانون المقارن. ----------------------------------------------The Implementation of Foreign Judgments in Algeria-Comparative study- Abstract (In English) : Implementing foreign judgments is one of the most important concerns in private international law. since the purpose of allocating the rules of this law branch is to settle disputes between members of private international relations and enable them to obtain a judgment, whether judicial or arbitration award, This ruling is useless if it is not allowed to be implemented outside the country it was issued from, therefore, most of the world's legislation considered the necessity of recognizing the effects of these provisions outside the territory of the state of issuing them to preserve the interests of individuals, yet they were not permitted to be implemented only if special conditions stated in the agreements and internal laws were met. Similar to comparative legislation, the Algerian legislator regulated the issue of Execution foreign judgments issued abroad whether judicial or arbitral through international and bilateral agreements, as well as the Civil and Administrative Procedures Law, But the latter did not improve the regulation of this matter. Keywords : foreign judgment –foreign judicial judgment- foreign Arbitral Award- Execution order -Algerian law-comparative study. ---------------------------------------------- L'exécution des jugements étrangers en Algérie - Étude comparative– Résumé (en français) : l’exécution des jugements étrangers est l’un des sujets les plus importants du droit international privé. puisque le but de l'attribution des règles de cette branche du droit est de régler les différends entre les membres des relations internationales privées et de leur permettre d'obtenir un jugement, qu'il s'agisse d'une jugement judiciaire ou arbitrale, Cette décision est inutile si elle n'est pas autorisée à être exécutée en dehors du pays d'où elle a été émise, par conséquent, la plupart des législations mondiales ont considéré la nécessité de reconnaître les effets de ces dispositions en dehors du territoire de l'État qui les a promulguées pour préserver les intérêts des individus, Toutefois, elles ne pouvaient être mises en œuvre que dans des conditions particulières régies par des conventions ainsi que par des lois nationales. Similaire à la législation comparée , le législateur algérien a réglé la question de l'exécution des jugements étrangers qu'ils soient judiciaires ou arbitraux par le biais d'accords internationaux et bilatéraux, ainsi que le code de procédures civiles et administratives, Mais ce dernière n'a pas amélioré la réglementation de cette matière.
