الاطار القانوني لتشغيل المحبوسين في التشريع الجزائري

Résumé: ترتكز السياسة العقابية الحديثة على مبادئ الدفاع الاجتماعي التي تجعل من تطبيق العقوبة أداة لحماية المجتمع من خلال إعادة تأهيل و تربية المحبوسين قصد تحضيرهم لمرحلة ما بعد الإفراج لإعادة إدماجهم في المجتمع من جديد،خاصة عن طريق الرفع من مستواهم التعليمي و كذا المهني، و يعد تشغيل المحبوسين أو ما يعرف بالعمل التربوي أحد تلك الأساليب، من خلال تكليف المحبوسين بأداء أعمال أو نشاطات تتناسب وقدراتهم البدنية و ميولهم النفسي سواء داخل المؤسسات العقابية ذات البيئة المغلقة أو خارجها في المؤسسات ذات البيئة المفتوحة و الورشات الخارجية ، أين يتم توظيف طاقات المحبوس البدنية والفكرية في نشاط إيجابي و تعلم عمل شريف يمكنه من تحقيق الإستقرار النفسي و الحصول على عائد مالي يلبي به احتياجاته المادية أو احتياجات أسرته ،كما يتعلم من خلال الانضباط داخل المجموعة و إحترام النظام و القوانين Modern penal policy is based on the principles of social defence, which make the application of punishment an instrument. to protect society Through the rehabilitation and upbringing of prisoners for post-release preparation to reintegrate them into Society, especially by upgrading their educational and vocational levels Educational work is one of those methods by assigning detainees to perform work. activities commensurate with their physical abilities and psychological orientation Whether within or outside closed-environment penal institutions in institutions with an open environmentand external workshop The physical and intellectual potential of the trapped is employed in a positive activity and an honest job is learned. It enables him to achieve psychological stability and a financial return that meets his material needsor family needs It also learns discipline within the group and respect for order and laws.
