"جريمة تهريب المهاجرين غير الشرعيين وآليات مكافحتها في التشريع الجزائري"

Résumé: الملخص: عرفت المجتمعات البشرية عبر مختلف الحقب التاريخية ظاهرة الهجرة بالانتقال من منطقة لأخرى ومن قارة لأخرى حتى وإن اختلفت البواعث والأسباب، كما أن نظرة الدول من خلال تشريعاتها تختلف في التعامل مع هذه الظاهرة خاصة ظاهرة تهريب المهاجرين( الهجرة غير المشروعة) التي أصبحت تستدعي جهودا دولية مشتركة من أجل الحد منها، من جهة ضمان حماية للمهاجرين من الاستغلال البشع من طرف شبكات المهربين من جهة أخرى، للتصدي لهذه الظاهرة ومكافحتها على المستوى الدولي، وعلى المستوى الوطني من خلال إقرار عقوبات مقررة لقمع هذه الجريمة. الكلمات المفتاحية :جريمة ،ظاهرة الهجرة ،غير الشرعية ،آلية المكافحة . Abstract: Human societies have known the phenomenon of migration from one region to another from one continent to another, even though the motives and causes differ. The view of countries through their legislation is different in dealing with this phenomenon, especially the phenomenon of smuggling of migrants (illegal migration) In order to limit them, on the one hand, to ensure that migrants are protected from the horrific exploitation of smugglers' networks on the other, to address and combat this phenomenon at the international level and at the national level through the adoption of penalties for the suppression of this crime.
