الرقابة القضائية على اعمال المحكمين في التحكيم التجاري الدولي

Résumé: إن الرقابة القضائية على أعمال المحكمين هي علاقة متكاملة وذات أثر قانون، ذلك أن لقضاء دور بارز في حماية الضمانات الأساسية التي تحقق عدالة الفصل في المنزاعات، فالأصل أن القضاء الوطني لا يتدخل في الدعوى التحكيمي غير أن حرية الأشخاص في الاتفاق على اللجوء إلى التحكيم قد تنقلب مضارة كبيرة إذا تركت دون رقابة، ومنه فما ساعد التحكيم على الانتشار هو الحل التحكيمي الذي يقدمه عن طريق إصدار الحكم التحكيمي وهذا ماتطرقنا إليه من خلال عملية البحث بداية بالحكم التحكيمي واصدراه وصولنا إلى الاعتراف به ويتنفيذه فالاعتراف ماهو إلا إجراء لاثبات الحكم التحكيمي بينما التنفيذ فيعد إجراء لإعمال هذا القرار، ثم تطرقنا نظام الطعن الذي لابد ان يكون أمام الجهات القضائية المختصة، حيث تناولنا الأنظمة القانونية للبطلان وأسبابه وكذا طرق الطعن في أحكام التحكيم بشقيه سواء كان الحكم التحكيمي الصادر خارج أو داخل الجزائر Abstract: Judicial oversight of the work of arbitrators is an integrated relationship with a legal effect, as the judiciary has a prominent role to play in protecting the basic guarantees that bring justice to the adjudication of disputes.
