رقابة القاضً الإداري على مشروعٌة القرار الإداري
Résumé: يعتبر مبدأ المشروعية من أهم المبادئ اللازمة لقيام الدولة القانونية، بحيث تغدو السيادة القانونية للقانون لا لأشخاص الحكم، ويقوم هذا المبدأ على أساس وجود قواعد صارمة تلتزم الإدارة باحترامها و مراعاتها في تصرفاتها، فمن واجب الإدارة التقيد بأحكام القانون في أعمالها منعا للتعسف في استخدام سلطتها وامتيازاتها، وهذا لضمان الحماية الكافية لحقوق الأفراد وحرياتهم، بحيث تتحقق هذه الضمانة من خلال تفعيل الرقابة القضائية، التي يمارسها القاضي الإداري على مشروعية القرار الإداري ومن بين وسائل الرقابة القضائية دعوى الإلغاء التي تهدف إلى إلغاء القرار الإداري ودعوى التعويض التي تهدف إلى تعويض من تضرر من الأعمال المادية والقانونية للإدارة، ويعد هذين النوعين من الدعاوى الأكثر شيوعا والتي من خلالها يمارس القضاء الإداري رقابته على النشاط الإداري، إلا أن هذا لا ينفي عدم وجود دعوى التفسير ودعوى تقدير المشروعية وهذه الدعاوى الشرعية، فهما وسيلة قانونية قضائية مقررة في النظام القانوني الجزائري، وتدخل ضمن اختصاص الجهات القضائية الإدارية. الكلمات المفتاحية: القاضي الإداري، مبدأ المشروعية ،الرقابة القضائية، القرار الإداري . The principle of legalityisconsidered one of the most important principlesnecessary for the establishment of the legal state, sothat the legalsovereignty of the lawbecomes not for the rulingpersons, and thisprincipleisbased on the existence of strict rulesthat the administration isobligated to respect and observe in its actions. This is to ensureadequate protection of the rights and freedoms of individuals, sothatthisguaranteeisachievedthrough the activation of judicialoversight, which the administrative judgeexercises over the legality of the administrative decision. The two types of lawsuits are the mostcommon, throughwhich the administrative judiciaryexercisesits control over administrative activity. However, thisdoes not negate the absence of the interpretation and legalitylawsuit and theselegitimatelawsuits, as they are a legal and judicialmeansestablished in the Algerian legal system, and are includedwithinCompetence of administrative judicialauthorities.
