مميزات دعاوى شؤون الأسرة على ضوء أحكام التشريع والاجتهاد القضائي الجزائري

Résumé: الملخص: الإجراءات في دعاوى شؤون الأسرة، على الرغم مما تتميز به من خصوصية، إلا أن قانون الإجراءات المدنية والإدارية يعتبر الشريعة العامة في مسائل التقاضي والقضاء. رأى المشرع تبسيط الإجراءات، ووضع أحكامها في قسم مستقل عنونه بـ"قسم شؤون الأسرة"، وفق منهجية تعتمد أساسا على مسار الدعوى بدأ باختصاص قسم شؤون الأسرة ثم الإجراءات الخاصة بكل دعوى، بما يحقق تجانسا مع باقي أحكام هذا القانون. Abstract: The Procedures in family affairs action, despite their peculiarities, the law on civil and administrative procedures is considered as the common law in matters of litigation and the judiciary. Therefore, the legislator saw simplifying the procedures, and setting their provisions in a separate section named "the Family Affairs" according to a methodology that mainly depends on the course of judicial proceedings. They initiated that section then procedures relevant to each claim in a way that harmonizes with the rest of the provisions of this law.
