Legal Challenges Of Ai-generated Journalism: Intellectual Property Rights And Regulations

Résumé: This article is dedicated to a critical component of news production and generation procedures using artificial intelligence tools, as journalists increasingly rely on these tools for media work. This has led to several issues centered around concerns primarily related to the right to own, protect, and dispose of media materials, as well as the news scoop in publishing them in particular. The journalist faces the dilemma of protecting his news content against journalists and media entities on one side, or against the AI company with the AI tool itself on the other. Here, the news content forms the basis of the news message related to the generation process, which raises various concerns, such as the republication of news in other outlets or its distortion or theft. In this light, this intervention aims to address these issues, seeking to answer the question: Is news produced through artificial intelligence tools deemed original, and who holds its intellectual rights? It is structured around key components that tackle the conceptual facet, followed by various real-world instances that illustrate intellectual property rights challenges in the media sector and methods to safeguard news and retain rights to its content and materials, which deepens the comprehension of this vital issue, particularly with the ongoing advancement of artificial intelligence in influencing the media environment. تحاول هذه الدراسة إثارة جانب مهم من عمليات صناعة الأخبار وتوليدها عبر أدوات الذكاء الاصطناعي،إذ أدى تنامي اعتماد الصحفيين على تلك التطبيقات في العمل الإعلامي إلى بروز عدد من القضايا تحفهّا ثلة من المخاوف المتعلقة أساسا بحق امتلاك المواد الإعلامية، حمايتها، التصرف فيها بصفة عامة، والسبق الاخباري في نشرها بشكل خاص، أين يجد الصحفي نفسه بين تحدي حماية محتوى خبره اتجاه الصحفيين، المؤسسات الإعلامية، من جهة، أو بينه وبين الشركة المالكة للأداة و أداة الذكاء الاصطناعي نفسها،..؛ حيث المحتوى الاخباري موضوع الرسالة الاخبارية إزاء عملية التوليد تلك تنطوي على عدد من المخاوف منها إعادة نشر الخبر في نواقل إعلامية أخرى أو تحريفه أو سرقته.
