آليات حماية المعطيات ذات الطابع الشخصي، في ظل القانون رقم 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي

Résumé: ذهبت العديد من التشريعات الدولية إلى تكييف منظومتها القانونية مع التطورات التكنولوجية والرقمية لاسيما في جوانب المعلوماتية والاتصالات بالاهتمام بمجال حماية الخصوصية بحماية البيانات الشخصية وتوضيح كيفية معالجتها والجزاءات المترتبة عند التعرض لها،والمشرع الجزائري بدوره تدارك هذا الجانب الحساس وأكد على حماية المعطيات الشخصية بموجب أحكام التعديل الدستوري لسنة 2016، ليليه إصدار القانون رقم 18-07 المتعلق بحماية الأشخاص الطبيعيين في مجال معالجة المعطيات ذات الطابع الشخصي، الذي أسهم في سد جانب من الفراغ الذي كان مسجلا في هذا المجال. ومن خلال هذه الدراسة حاولنا إبراز مختلف آليات الحماية التي كرسها هذا القانون رقم والوقوف على مدى تفعيلها ونجاعتها لاسيما عند المعالجة الآلية للمعطيات الشخصية. Abstract: Much international legislation has adapted its legal system to technological and digital developments, especially in the aspects of informatics and communications, with an interest in privacy protection and in clarifying how to handle it and the sanctions that follow when exposed to it. The Algerian legislature, in turn, is redressing this sensitive aspect and has emphasized the protection of personal data under the provisions of the 2016 constitutional amendment, followed by the promulgation of low 18-07, which has contributed to filling part of the vacuum that has been recorded in this area. This study tried to highlight the different protection mechanisms that this law devoted to, and to see how they are effective and effective, especially when the personal data is automatically processed.
