حق الدول في ممارسة الحرب وفقا لميثاق الأمم المتحدة The Right Of States To Wage War In Accordance With The Charter Of The United

Résumé: ورث الاتحاد الروسي العضوية الدائمة في مجلس الأمن الدولي عقب تفكك الاتحاد السوفياتي؛ وبذلك يشكل وجوده بهذه الصفة أهمية قانونية وسياسية باعتباره قوة عالمية يقع عليها واجب الالتزام بميثاق الأمم المتحدة، والذي يرمي إلى غاية سامقة هي حفظ السلم والأمن الدولي؛ غير أن الحرب التي باشرها الاتحاد الروسي منذ 24/02/2022 على أحد أعضاء الأمم المتحدة وهي دولة أوكرانيا أثارت تساؤلات المختصين في القانون الدولي حول المبررات القانونية لهذه الممارسة ؛ وأعادت الجدل القانوني حول حق الدول في ممارسة الحرب وفقا لميثاق الأمم المتحدة، ولذلك سنحاول تحليل ومناقشة القواعد النظرية في ميثاق الأمم المتحدة التي نظّمت هذه الممارسة. Abstract : The Russian Federation inherited the permanent membership UN Security Council after the dissolution of the Soviet Union, Its presence in this capacity, has since then , constituted a legal and political importance as a global power that has the duty abide by the charter of United Nations, whose ultimate aim maintaining international peace and security. however, the fact that the Russian Federation declared war on 24/02/2022, against Ukraine, which is also a member of the United Nations has raised a lot of questions on the part of international law experts on the legal justifications of this practice hence , it has revived the legal debate on the right of states to wage war in accordance with the Charter of the United Nations. Therefore, this paper will try to analyze and discuss the theoretical bases that regulate such practice in light of the Charter of the United Nations.
