التدخل العسكري لفرض احترام الديمقراطية في الممارسة الدولية المعاصرة Military Intervention To Enforce Respect For Democracy In Contemporary International Practice

Résumé: تشهد الممارسة الدولية المعاصرة للقانون الدولي إقدام بعض الدول على التدخل في شؤون دول أخرى، بصورة مباشرة، باللجوء إلى القوة العسكرية على الرغم من حظر التدخل في شؤون الدول وفقا لميثاق الأمم المتحدة، وتحديدا في المادة 2/7، وقرارات الجمعية العامة للأمم المتحدة التي تكرس هذا المبدأ، ومنها: القرار رقم: 2131، بتاريخ: 21/09/1965 والقرار رقم: 36/103، بتاريخ: 09/12/1981؛ ومبدأ حظر التهديد باستعمال القوة أو استخدامها في العلاقات الدولية في المادة 2/4 من ميثاق الأمم المتحدة. تحاول الدول المتدخلة تبرير هذه الممارسة الدولية بمحاولة فرض احترام الديمقراطية في الدول محل التدخل العسكري؛ لذا رأينا أنه من الواجب مناقشة وبيان مشروعية هذه الممارسة في القانون الدولي The contemporary exertion of international law witnesses some States intervene directly in the internal affairs of some other States by resorting to military force despite such intervention is prohibited according to the U N charter specifically in Article 2\7, and the General Assembly resolutions including 2131on 21\9\1965and resolution 36\103 on 09\12\1981 all of which emphasize this principle as well as the doctrine which bans threatening by force or exerting force in international relations as represented in Article 2\4 of the U N charter. The intervening nations have the tendency to justify these actions by considering them an attempt to enforce democracy in those States subjected to military intervention. Within this context, this paper seeks to examine and discuss the legality such practices with reference to the international law.
