Résumé: تطرقنا في هذه المذكرة لدراسة تقنية تفويض المرفق العام كطريقة حديثة لضمان استمرارية سير المرافق العامة كونها الحل الأمثل لأن أسلوب التفويض ما هو إلا انتقال الإدارة من التسيير المباشر إلى الإدارة غير المباشرة وهذه فكرة ليست بجديدة في التشريع الجزائري و إنما لم يتم التواصل إلى اعتماد سياسة شاملة ومنظمة لهذه العقود الإدارية في إطار قانوني إلا أن تبنت الدولة هذا الأسلوب و صدر المرسوم الرئاسي 15-247 الذي تضمن تنظيم عقود تفويض المرفق العام لأول مرة منذ الاستقلال ثم تلاه المرسوم التنفيذي 18-199 المتعلق بتفويضات المرفق العام الكلمات المفتاحية: التفويض – العقود – مرفق العام المحلي Summary In this memorandum, we discussed the technique of delegating the public utility as a modern way to ensure the continuity of the functioning of public utilities, as it is the best solution because the delegating method is nothing but the transfer of management from direct management to indirect management.
