عقوبة الإعدام في ظل أحكام القانون الدولي لحقوق الإنسان

Résumé: ملخص: تستهدف هذه الدراسة البحثية، موضوع عقوبة الإعدام في ظل أحكام القانون الدولي لحقوق الانسان، لما لها من خطورة على الحق في الحياة، فهي تعتبر من أشد العقوبات قسوة، كما تهدف إلى إبراز موقف القانون الدولي منها، و الاختلاف الذي لا يزال قائما بين الدول حول تطبيقها من عدمه. خلصت الدراسة، إلى أنه رغم النص على مسألة إلغاء عقوبة الإعدام في معاهدات دولية عالمية وإقليمية أوروبية وأمريكية وعربية وافريقية، واعتماد عدة هيئات تابعة للأمم المتحدة تدابير لدعم الدعوة إلى إلغاءها، وإصدارها لعدة قرارات تهدف إلى وقف استخدامها، يبقى الاختلاف قائما بين الدول حول الإبقاء عليها أو إلغاءها أو تجميدها، كما أن أغلب الدول التي ما زالت تطبق هذه العقوبة لا توفر الحمایة الواجبة لحقوق المحكوم عليهم بعقوبة الإعدام، ولا تحترم القواعد والمعايير الدولية المتعلقة بالمحاكمة العادلة وغيرها من القواعد ذات الصلة بحقوق الإنسان. Abstract: This study tackles the subject of the death penalty under the provisions of international human rights law because of its dangerous implication on the right to life, and it is one of the toughest punishments. It also aims at highlighting the stance of international law towards it and the existing disagreement between states regarding whether to implement it or not. The study concluded that despite the provision of the abolition of the death penalty in international, regional, European, American, Arab and African human rights conventions, and the adoption by the international community of several actions to abolish the death penalty, a divergence remains between States about maintaining, abolishing or freezing it, and most of the countries that still apply this sentence does not guaranty the sentenced rights, and does not respect the international laws and norms regarding a fair trial and many other rules related to human rights.
