التسوية الودية لنزاعات تنفيذ الصفقات العمومية في ضوء المرسوم الرئاسي رقم 15/247

Résumé: الملخص: تعد التسوية الودية طريقة ذات اهمية اساسية في مجال ايجاد حلول ودية ونهائية لنزاعات تنفيذ الصفقات العمومية بأسرع وقت وبأقل تكلفة، تجنب، من جهة، تعطل انجاز مشاريع التنمية الاقتصادية والاجتماعية، ومن جهة اخرى، المنازعة القضائية، لذلك خصها المرسوم الرئاسي رقم 15/147 لسنة 2015 بجملة من الأحكام ، و قد تضمنت أهم هذه الاحكام التنصيص على التفاوض المباشر ، و انشاء لجنة للتسوية الودية في كل وزارة و هيئة عمومية ، و في كل ولاية تجسيدا للامركزية التسوية. لذلك ، تسعى هذه الدراسة بالتحليل و المناقشة للنظام القانوني لهذه التسوية من خلال الوقوف على تشكيل طرقها الودية واختصاصاتها، وأيضا، الإجراءات التي تحكم عملها وتنفيذ نتائجها. Abstract: Amicable settlement is a method of fundamental importance in the field of finding amicable and final solutions to disputes of the execution of public procurements as soon as possible and at the lowest cost, avoiding disruption to the implementation of economic and social development projects and the litigation. Therefore, Presidential Decree No. 15/147 of 2015 singled it out with a number of provisions. The most important of these provisions direct negotiation, and the establishment of a committee for amicable settlement in each ministry and public body, and in each Wilaya to embody the decentralization of settlement. this study seeks to analyze and discuss the legal system of this settlement by identifying the formation of its cordial methods and competencies, as well as, the procedures that govern its work and the implementation of its results.
