الالتزام بتسليم منتوج مطابق في البيع العادي والإلكتروني (دراسة مقارنة)

Résumé: تعتبر المطابقة من المواضيع القانونية الهامة في منظومة التزامات البائع في عقد البيع العادي بصفة عامة والبيع الالكتروني بصفة خاصة بالنظر إلى خصوصية هذا النوع من التعاقد، حيث يشترط ان يكون المبيع مطابقا للمواصفات القانونية والقياسية ويكون صالحا للاستعمال المعد له بغرض إشباع رغبة المستهلك وتكريسا للقوة الإلزامية للعقد. حرصا على تنفيذ الالتزام بالتسليم المطابق للمبيع وضعت اليات قانونية تحت تصرف المشتري أو المستهلك عند اخلال به وذلك ضمن قوانين وطنية أو في التشريع المقارن. Abstract: Conformity is considered one of the important legal issues in the seller's obligations system in the normal sales contract in general and electronic sales in particular, given the specificity of this type of contract, as it is required that the sold conforms to legal and standard specifications and be suitable for the intended use for the purpose of satisfying the consumer's desire and consecrating the obligatory power for the contract. In order to ensure the implementation of the commitment to the delivery of identical sales, legal mechanisms have been placed at the disposal of the buyer or the consumer in the event of a breach of it within national laws or in the comparative legislation.
