أثر الالتزام بالإعلام ما قبل التعاقدي على استقرار العقد الالكتروني

Résumé: الملخص: أدى انتشار استعمال تقنية الأنترنيت في المعاملات التجارية إلى منح المستهلك إمكانية التسوق في بيئة افتراضية والولوج إلى أي مكان في العالم لاختيار السلعة أو الخدمة التي يبحث عنها، والحصول عليها بسرعة، دون عناء التنقل والحضور المادي له وبأقل تكلفة. لكن استعماله للوسائط الإلكترونية تعرضه لعملية التضليل والخداع والغش من طرف المورد الإلكتروني، خاصة وأن محل العقد لا يمكن له معاينته ماديا ولا التحقق من وجوده الفعلي ولا حتى التأكد من صحة المعلومات المقدمة له أثناء العرض التجاري الإلكتروني. مما يزعزع ثقة المستهلك الإلكتروني ويعرض عقود البيع الإلكترونية لعدم الاستقرار. الأمر الذي دفع المشرع الجزائري الى تنظيم أحكام التجارة الإلكترونية بموجب قانون رقم 18-05 المؤرخ في 10 ماي 2018، أين ألزم المورد الإلكتروني بالإعلام المستهلك الإلكتروني قبل ابرام العقد، لإعادة التوازن المعرفي بينهما وتوقي المخاطر التي تهدد استقرار العقد. Abstract: The spread of the use of Internet technology in commercial transactions has given the consumer the ability to shop in a virtual environment and access anywhere in the world to choose the good or service he is looking for, and get it quickly, without the hassle of transportation and physical presence at the lowest cost. But his use of electronic media exposes him to the process of misleading, deception and fraud by the electronic supplier, especially since the subject of the contract cannot be physically inspected, nor verify its actual existence, nor even verify the correctness of the information provided to him during the electronic commercial offer. This destabilizes electronic consumer confidence and exposes electronic sales contracts to instability. Which prompted the Algerian legislator to regulate the provisions of electronic commerce under Law No. 18-05 of May 10, 2018, where the electronic supplier obligated the electronic consumer to inform the electronic consumer before concluding the contract, to restore the knowledge balance between them and prevent risks that threaten the stability of the contract
