الالتزام بالإعلام الالكتروني كآلية لضمان الأمن التعاقدي

Résumé: يتميز التعاقد الإلكتروني بكون المستهلك الإلكتروني غالبًا جاهلا بمحل التعاقد، لذا تم إقرار الالتزام بالإعلام الإلكتروني حتى يتم تكريس الأمن التعاقدي في العلاقة التعاقدية الإلكترونية، وهو منطلق هذه الدراسة الهادفة لتسليط الضوء على إحدى الآليات التي تسمح بتفعيل الأمن التعاقدي والمتمثلة في الإعلام الإلكتروني باعتباره التزاما يسبق التعاقد الإلكتروني، ويقع على عاتق التاجر الإلكتروني من خلال إعلام المستهلك الإلكتروني بكافة المعلومات والبيانات الجوهرية. وهذه الآلية كُرست تدعيما للمركز القانوني للمستهلك إذ أن اعتباره الطرف الأضعف في المعادلة التعاقدية، يجعل من الضروري توفير السبل الحمائية له، وهو ما يسمح بتدعيم الثقة في التعامل الإلكتروني مما يسمح بتعميمه وجعله خيارا استراتيجيا للاقتصاد الوطني.. Electronic contracting is characterized by the fact that the securit consumer is often ignorant of the content of the contract, so the commitment to inform in electronic contract has been established so that contractual security is established in the electronic contractual relationship. It is the responsibility of the e-merchant to inform the electronic consumer of all the essential information and data. This mechanism is dedicated to strengthening the legal position of the consumer, as considering him as the weakest party in the contractual equation, it is necessary to provide him with protective means, which allows strengthening confidence in electronic dealing, allowing its circulation and making it a strategic choice for the national economy
