البدائل الإجرائية للدعوى الجزائية في التشريع الجزائري

Résumé: اإن ما جاء به الأمر رقم 15/02 المتضمن تعديل قانون الإجراءات الجزائية يركز في أساسه على إيجاد بدائل إجرائية في الدعوى الجزائية، وهذا للتخفيف من عبء تكدس القضايا وطول الإجراءات مما يختصر الوقت ويسرع من وتيرة عمل القضاء الجزائي. فالوساطة تهدف إلى التوفيق بين طرفي النزاع دون الحاجة إلى اللجوء للمتابعة الجزائية، كما أن المثول الفوري المطبق في الجنح المتلبس بها هو إجراء استثنائي يضع حد للخصومة الجزائية بصورة بسيطة وسريعة بعيدا عن المحاكمة العادية، أما الأمر الجزائي فهو لا يختلف في أهدافه عن سابقيه؛ فإذا توفرت شروطه يفصل في ملف الدعوى دون محاكمة مع حفظ حق الأطراف في الاعتراض. إلا أن التطبيق العملي لهذه الإجراءات المستحدثة يطرح بعض الإشكالات التي يمكن تفاديها بسد الثغرات وتكملة النقص في تنظيم هذه الإجراءات وهو ما نحاول بيانه. Law No. 15/02, which includes the amendment of the Code of Criminal Procedure, focuses on finding alternatives to the criminal case, in order to alleviate the burden of cases and the length of proceedings, thus shortening the time and accelerating the pace of the criminal justice system. Mediation is aimed at reconciling the parties to the conflict without the need to resort to criminal follow-up, and the immediate appearance applied in misdemeanors is an exceptional procedure that puts an end to the criminal dispute in a simple and expeditious manner away from the ordinary trial. The penal procedure is no different in its objectives than its predecessors. Cairo's case is set out without trial and the parties' right to object is preserved. However, the practical application of these new procedures raises some problems that can be avoided by bridging the gaps and supplementing the lack of organization These Procedure are what we are trying to explain.
