دور لجنة الطعن المختصة في مجال ترقية الاستثمار بين: الفعالية والمحدودية

Résumé: في سبيل عصرنة آليات تسوية نزاعات الاستثمار، أقر القانون رقم 16-09 المتعلق بترقية الاستثمار بدور لجنة الطعن المختصة، فأسند لها النظر في الطعن الذي يقدمه كل مستثمر يرى أنه غبن بشأن الاستفادة من المزايا، من طرف أي إدارة أو هيئة مكلفة بتنفيذ قانون الاستثمار أو كان موضوع إجراء سحب أو تجريد من الحقوق. رغم أن هذا الطعن تحكمه بعض القواعد، تشكل ضمانات للمستثمر وحماية له في مواجهة تلك الإدارات، إذ تسمح له بالحصول على تسوية سريعة لنزاعه وبأقل التكاليف. لكنها تبقى غير كافية للإقرار بفعالية دور اللجنة في تسوية نزاعات الاستثمار. The role of the competent appeals committee in investment promotion, between efficiency and limits In order to modernize the mechanisms for settling investment disputes, Law n° 16-09 relating to the promotion of investment approved the role of the appeals commission, giving it the power to examine appeals brought by any investor who considers himself aggrieved as to the granting of advantages, by any administration or body responsible for the implementation of the law on investment, or subject to a withdrawal or a forfeiture procedure. Admittedly, this remedy is governed by certain rules, which constitute guarantees for the investor and protect him from the competent administration in the matter, and allow him to obtain a rapid settlement of his dispute at the lowest cost. However, they remain insufficient to affirm the effectiveness of the role of the appeals committee in settling these disputes
