خصوصية سياسة التجريم و العقاب في قطاع الأعمال بالجزائر

Résumé: تتميز سياسة التجريم بذاتية و خصوصية عندما يتعلق الأمر بقطاع الأعمال ، من منطلق أن الأعمال و الاستثمار يساهمان بصورة ايجابية في تطور الاقتصاد ككل ، إذ يلاحظ وجود جملة من الاستثناءات التي ترد على أحكام التجريم المألوفة في القواعد العامة أي قانون العقوبات . فمن حيث الركن الشرعي المقوم لجريمة الأعمال يلاحظ أن التجريم ليس مترجم بتقنين موحد بل نجده ترسانة قانونية هنا و هناك بالإضافة إلى تبني المشرع الجزائري في مادة الأعمال ما يعرف بإجراء التفويض التشريع أو ما يصطلح عليه البعض بالتشريع على بياض، ناهيك عن الخصوصية من حيث الركن المادي أين صار الحديث عن جرائم الخطر و جرائم الضرر ، و هو ذات الأمر بالنسبة للركن المعنوي أين أصبح في الغالب مفترض لا مشترط . و عندما يتعلق الأمر بالمنظومة العقابية فقد أقر المشرع الجزائري إمكانية مسائلة الشخص عن فعل الغير ، و اعترف بما يسمى بالمسؤولية الجنائية للشخص المعنوي ، مع إقرار ما يعرف بالجزاء الإداري كبديل للجزاء الجنائي ، مع التخفيف من العقوبات السالبة للحرية و استبدالها بالعقوبات المالية . Abstract: privacy when it comes to the business sector, on the grounds that business and investment contribute positively to the development of the economy as a whole, as it is noticed that there are a number of exceptions that are contained in the criminalization provisions familiar in the general rules, i.e. the Penal Code. In terms of the legal element based on business crime, it is noticed that its source is not uniform, but is found through a legal arsenal here and there, not to mention privacy in terms of the material element. Mostly assumed. And when it comes to the penal system, the Algerian legislator has recognized the possibility of a person being held accountable for the actions of others, and acknowledged the so-called criminal responsibility of the legal person, while approving what is known as administrative punishment as an alternative to criminal punishment, while reducing freedom-depriving penalties and replacing them with financial penalties
