التحديات القانونية لتجسيد سياسة إزالة التجريم عن فعل التسيير في الجزائر

Résumé: إن ظهور فكرة إزالة التجريم عن فعل التسيير جاء بالموازاة مع أزمة العدالة الجزائية وعجزها عن مسايرة وملائمة خصوصية النشاط الاقتصادي ومتطلباته، وجاء لتحقيق القدر المعتبر من الأمن القانوني الذي يحتاج له الموظف في إطار ممارسة وظيفته والعون الاقتصادي في إطار انجازاستثماراته، لذا أصبح من الضروري إيجاد التقنية القانونية للتوفيق بينهما من حيث تعطش كلاهما لميزة الأمن القانوني، وهو ما استدعى تبني مبدأ التدخل الاحتياطي للقانون الجنائي في مجال الأعمال من خلال تبني فكرة إزالة التجريم عن الجرائم التي تتمتع بقدر معتبر من الخصوصية، بحيث لا يمكن أن نفهم من مضمونها القيام باستبعاد القواعد الجزائية عن فعل التسيير، بل يبقى فعل التسيير مستسقي لقواعده من مبادئ القانون العقابي العام بالرغم من إنشاء الترسانات الخاصة، لكن مع إضفاء القدر اللازم من المرونة (الأمر الجزائي، عوارض الدفع، الوساطة، حفاظا على المصالح والتخفيف من تضاربها، وضمان القدر اللازم من الأحقية العمومية لرقابة النشاط الاقتصادي.
