Résumé: إن الفقه الإسلامي بما يقوم عليه من أصول صحيحة وكثيرة جعلته صالحاً للتطبيق في كل زمان ومكان، قابلاً للنماء في جوانبه المختلفة، وللتدليل على هذا النماء وقابلية التطبيق والقدرة على مواكبة المستجدات، يتناول هذا البحث الجوانب التي ظهر فيها التجديد الشكلي والتجديد المتفق مع الأصول التي قام عليها الفقه الإسلامي والخارج عنها ليعطينا صورة أشمل . وقد تناولنا في هذا البحث العوامل التي يمكنها التأثير في تجديد قواعد الشخصية سواء كان منها العوامل العامة أو العوامل الخاصة . مع بيان آثار التجديد على قواعد الأحوال الشخصية الإيجابي منها والسلبي وبيان مجموعة ضوابط ينبغي مراعاتها في التجديد. The Islamic Jurisprudence is which based on truthful and various foundations makes it fit to be applicable at any time or place and is capable of being developed in all it's parts. To justify this, research deals with the parts that show the renewal in the civil status issues. It is not limited to the substantive renewal but it included the context renewal that goes with the principles which the Islamic jurisprudence is based upon in order to give more comprehensive picture to the subject. For the purposes of ordering and indexing, the research handles the factors that affect the renewal of the issues of civil status.
