التقعيد الأصولي والفقهي عند العلامة ابن القصار المالكي (397ه) من خلال كتابه عيون الأدلة وأثره في مدونات المالكية

Résumé: يهدف هذا البحث إلى لفت الانتباه إلى مدى مساهمة الإمام العلامة أبي الحسن علي بن عمر بن أحمد البغدادي المالكي المعروف بابن القصار (ت ٣٩٧هـ) في ميدان التقعيد الأصولي والفقهي من خلال كتابه النفيس "عيون الأدلة في مسائل الخلاف بين فقهاء الأمصار"، والذي يعتبر من أجلّ ما صُنّف في علم الخلاف العالي لدى المتقدمين، ولا يخفى على المتخصصين أن كتب الخلاف هي من أغنى الكتب مادة للقواعد الفقهية والأصولية. ولقد وجدنا ابن القصار يوظف القواعد الأصولية والفقهية حال عرض الخلاف وبيان منشئه، وفي ردوده ومناقشاته، وفي ترجيحاته واختيارته، بحيث حوى كتابه المذكور مادة تقعيدية معتبرة مسَّت الميدان الفقهي والأصولي، وسنشير إلى نماذج منها في هذا البحث مع إبراز سمات التقعيد الأصولي والفقهي عند ابن القصار، وبيان مدى تأثير كلامه المتعلق بالتقعيد في مدونات المالكية. We have found the son of a minor who employs fundamentalist and doctrinal norms once the dispute is presented and the origin of the dispute, in his responses and discussions, in his weights and his choice, so that the content of the said book is regarded as subjective material that touched the field of jurisprudence and fundamentalism, and we will refer to examples thereof in this research, highlighting the characteristics of the fundamentalist and theoretical regularization of the minor's son, and indicating the impact of his speech on the recalteration
