دور التحكيم في إعادة التوازن المالي للعقد الإداري

Résumé: في ظل تنامي أهمية التحكيم كوسيلة لفض منازعات عقود القانون الخاص، فقد دأبت الدول على تطبيقه على العقود الإدارية خاصة مع زيادة التعاقدات التي تبرمها الإدارة مع الأجانب، فجعلته جزءا من نظامها القانوني وذلك ما جعل المشرع الجزائري يجيز لأشخاص القانون العام إمكانية الخضوع للتحكيم، بموجب قانون الإجراءات المدنية والإدارية، ويتم تطبيقه خاصة في منازعات التعويض عن اختلال التوازن المالي للعقد الإداري، والتي تحتاج في ذلك إلى سرعة وبساطة إجراءات التحكيم. Abstract: In light of the growing importance of arbitration as a means of resolving disputes in private law contracts, states have been applying it to administrative contracts, especially with the increase in contracts concluded by the administration with foreigners, making it part of its legal system, and that is what made the Algerian legislator allow public law persons to be subject to arbitration, according to the law Civil and administrative procedures, and it is applied especially in compensation disputes for the financial imbalance of the administrative contract, which requires the speed and simplicity of arbitration procedures.
