تنظيم الملكية الغابية في التشريع الجزائري

Résumé: تعتبر الغابات ثروة وطنية من الثروات المنصوص عليها في الدستور الجزائري، وتعد الملكية الغابية في التشريع الجزائري ملكية عقارية على اعتبار أنّ الأملاك العقارية هي كل الثروات العقارية غير مبنية. وهي تبعا لمعيار صاحب الملك، إمّا أن تكون ملكية غابية وطنية أو ملكية غابية خاصة. والملكية الغابية الوطنية تدرج ضمن الأملاك الوطنية العمومية، وهذا بموجب المادة 12 من قانون الأملاك الوطنية رقم: 90/30 المعدل والمتمم. هذا وتمارس الدولة على الأملاك الغابية الوطنية نفس الحق الذي تمارسه على الأملاك الوطنية العمومية، وهو حق الملكية. كما تحض بنفس الحماية المقررة لها وهي عدم قابليتها للتصرف وللتقادم وللحجز. أمّا الملكية الغابية الخاصة فتندرج ضمن الملكية العقارية الخاصة، طبقا لما جاء في قانون التوجيه العقاري رقم: 90/25. ونظّم أحكام النوعين من الملكية الغابية المشرع الغابي بموجب القانون رقم: 84/12 المتضمن النظام العام للغابات. Abstract: Forests are considered as one of national resources mentioned in the constitution. The forest property is considered a real estate property on the grounds that the property forest is all the real estate resources inbuilt. Depending on the land owner of property criterion; the forest property is either national forest property or private forest property. National forest property is listed in public national property and that under the article 12 of national property law N°90-30 modified and complemented. The state exercises on this national forest property the same right which is exercised on public national property, and it is given the same protection which is: inalienability, inability of limitations, inability seizure. However, the private ownership of property is included in real estate private property, according to the real estate law directive n°90-25.The legislator forest also regulated the provisions of forested private property under the law n°84-12 containing the general law of forests.
