لحماية الجنائية لبراءة الاختراع في ظل الأمر 03-07
Résumé: إن مجال الملكية الصناعية هو الصناعة والتجارة، لهذا تندرج بعض موضوعاتها ضمن أحكام القانون التجاري، أما البعض الآخر فوضع لها المشرع الجزائري قواعد خاصة تنظمها، وهو شأن براءة الاختراع فقد أفرد لها حماية خاصة بمقتضى الأمر رقم 03-07 المؤرخ في 19 يوليو عام 2003، وهذه الحماية لا تقتصر رفع الدعوى المدنية للحصول على التعويضات في حال وجود اعتداء على البراءة، بل تشمل الحماية الجزائية التي تقوم على معاقبة كل من تخول له نفسه جنحة تقليد الاختراع. Abstract: The field of industrial property is industry and commerce. Some of its subjects come under commercial laws, but some of them have been given special rules by the Algerian legislator that regulate them, including patents. They have been given special protection in accordance with decree no. 03/07 dated 19th July 2003. This protection is not limited to fling a civil action to obtain compensation in the event of patent infringement.
