نظام وقف تنفيذ العقوبة كبديل للحبس قصير المدة في التشريع الفلسطيني

Résumé: الملخص: يعد نظام وقف تنفيذ العقوبة من أهم اساليب المعاملة العقابية والتفريد العقابي في السياسة الجنائية الحديثة، وقد تبنى المشرع الفلسطيني نظام وقف تنفيذ العقوبة في قانون الاجراءات الجزائية رقم (3) لسنة 2001، ويركز مجال الدراسة على معرفة نظام وقف تنفيذ العقوبة ومدى جدية هذا النظام بتحقيق اهدافه في اصلاح المحكوم عليهم، ومعرفة الشروط المطلوبة التي يقرها القانون وتنسجم وتتطابق مع شخصية المحكوم عليه والمرتهنة بحرية اقتناع القاضي. بالاضافة الى اثار وقف تنفيذ العقوبة سواء بانقضاء فترة التجربة بنجاح دون ارتكاب المستفيد من هذا النظام جريمة اعتبر الحكم كان لم يكن، اما في حالة عدم نجاح التجرية وارتكب المحكوم عليه جريمة هنا يتم الغاء وقف التنفيذ وتطبق عليه العقوبة وجميع الاثار الجزائية. Abstract: The system of suspending the implementation of punishment is one of the most important methods of punitive treatment and punitive individualization in modern criminal policy, The Palestinian legislator has adopted the system of suspending the execution of the penalty in the Criminal Procedures Law No. (3) of 2001, and the field of study focuses on knowing the system of suspending the execution of the penalty and the extent of the seriousness of this system in achieving its goals in reforming the convicts, and knowing the required conditions approved by the law and consistent with the personality of the convict. It is freely mortgaged to the conviction of the judge. In addition to the effects of suspending the execution of the penalty, whether by the successful expiration of the trial period without the beneficiary of this system committing a crime, the judgment was deemed not to have been, but in the event that the trial was not successful and the convict committed a crime here, the stay of execution is canceled and the penalty and all penal effects are applied to him.
