الرقابة الادارية على عمليات التجميع الاقتصادي آلية لحماية المنافسة الحرة في السوق

Résumé: تكريسا لمبدأ الحرية التعاقدية و حرية التجارة و الصناعة أجاز المشرع الجزائري للمؤسسات القيام بالعمليات التي يترتب عنها انشاء التجميعات الاقتصادية، و ذلك بهدف تعزيز المكانة الاقتصادية للمشاريع الصغيرة و الحديثة و تدعيم قوتها لمواجهة منافسيها، فأصبحت المؤسسات الصغيرة و المتوسطة تلجأ الى ذلك كضرورة حتمية لمواجهة التحديات الاقتصادية و ضمان بقائها في السوق. غير أن المشرع تفطن في نفس الوقت لاحتمال ترتيب آثار سلبية من هذه الكيانات نتيجة لإخلالها بمبدأ المنافسة الحرة و التي غالبا ما تؤدي الى بروز وضعيات هيمنة و احتكار للسوق ، فأخضعها بذلك لرقابة مجلس المنافسة و كذلك لسطات الضبط المستقلة كما اشترط ضرورة الحصول على ترخيص من هذه السلطات الادارية لإنشاء هذه الكيانات حفاظا على انتظام السوق و تجسيدا لمبادئ المنافسة النزيهة. In accordance with the principle of contractual freedom, freedom of trade and industry, Algerian legislators have authorized enterprises to carry out the processes that entail the establishment of economic groupings, with a view to enhancing the economic status of small and modern enterprises and strengthening their power to confront their competitors.
