منهج التشريع الإسلامي في حماية الأسرة من الطلاق والخلع (في اطار الملتقى الدولي الأطر الحمائية للأسرة و دورها في استقرار المجتمع)

Résumé: ملخص: يسعى البحث لمعالجة قضية انتشار الطلاق والخلع، وذلك ببيان منهج التشريع الإسلامي في حماية الأسرة من التفكك، من خلال ترسيخ سبل حل المشاكل الزوجية بإتباع جميع مراحل الإصلاح المقررة في الشريعة الإسلامية قبل إيقاع الطلاق، والعمل بالضوابط والقيود والآداب التي تسبق فك رابطة الميثاق الغليظ فيكون الفراق آخر الدواء، وبيان الحكمة من وضع عصمة فك الرابطة الزوجية بيد الرجل حماية للأسرة، ويأتي البحث كخطوة تسعى لتفعيل منهج التشريع الإسلامي في التشريعات القانونية قصد الحفاظ على الأسرة وحمايتها. Abstract: The research seeks to address the issue of widespread divorce and dislocation, by demonstrating the approach of Islamic legislation in protecting the family from disintegration by entrenching ways of solving marital problems by following all stages of the reform established in the Islamic sharia before the divorce. And to act with the controls, restrictions and ethics that precede the dissolution of the High Charter Association so that the difference is the last medicine and demonstrate the wisdom of placing the disintegration of the marital bond with the man in order to protect the family, The research is a step that seeks to operationalize the curriculum of Islamic legislation in legal legislation in order to preserve and protect the family
