الضمانات القبلية والبعدية لاستمرارية الأسرة في الشريعة (في اطار الملتقى الدولي الأطر الحمائية للأسرة و دورها في استقرار المجتمع)

Résumé: سن الإسلام عديد التشريعات لضمان استمرارية مؤسسة الأسرة وديمومتها؛ منها ما هي ضمانات وإجراءات قبل بناء الأسرة، ومنها أحكام بعد نشوئها، وقبل حدوث الخلاف، ومنها أحكام أخرى لحفظ كيان الأسرة واستمراريتها حتى بعد قرار فك الرابطة؛ قصدا إلى بقائها. وبالتحليل والاستقراء، ومن خلال مدخل تمهيدي، ومبحثين اثنين، خصص الباحث الأول منهما لتشريعات استمرارية الأسرة قبل البناء، والثاني لتشريعات استمرارية الأسرة بعد البناء؛ يهدف الباحث إلى إظهار اهتمام الشريعة بالترابط الأسري، قبل حدوث النزاعات والخلافات وبعدها، وطرقها في ذلك، وتجليات مقصد استمرارية الزوجية من خلال ذلك. Abstract: Islam enacted numerous legislations to ensure thecontinuity of the family institution. Some of them are guarantees and procedures before construction, and some of them are provisions after the establishment of the family, and before the occurrence of the dispute, and among them are other provisions to preserve the family entity and its continuity even after the decision to break the bond; in order to survive it. By analysis and induction, and through an introductory introduction, and two topics, the first researcher devoted to family continuity legislation before construction, and the second to family continuity legislation after construction; The researcher aims to show Sharia's interest in family bonding, before and after the occurrence of conflicts and disagreements, and its methods for that, and the manifestations of the purpose of marital continuity through that.
