تدبير تسليم الطفل في خطر إلى أشخاص وعائلات جديرين بالثقة

Résumé: ملخص: تحتل تدابير التسليم أهمية كبيرة في مجال قضاء الأحداث بكل صورها كونها تحافظ على الجو العائلي اللازم لتكوين شخصية الطفل من جهة، وتساهم في إبعاد الطفل عن مصدر الخطر من جهة أخري، وقد استحدث المشرع الجزائري آلية جديدة في تدابير التسليم لم تكن موجودة من قبل ، تتمثل في تسليم الطفل في خطر لعائلة أو أشخاص جديرين بالثقة من أجل تولي رعايته، ويحيط موضوع الدراسة بتحليل وقراءة نقدية لمجمل أحكام المرسوم التنفيذي رقم 19-70 الذي يحدد الشروط الواجب توافرها في الأشخاص والعائلات التي ستسند لها مهمة الرعاية، وكيفية تنظيم التشريعات المقارنة لهذه المسألة، وصولا إلى اقتراح إضافات جديدة للمواد التي يظهر فيها القصور، أو حتى الإغفال عن تنظيم مسألة ما من أجل توفير حماية أفضل ومراعاة لخصوصية الطفل في المجتمع الجزائري المسلم. Abstract: Handovers measures occupy great importance in the field of juvenile justice in all its forms, as they maintain the necessary family atmosphere for the formation of the child’s personality on the one hand, and contribute to keeping the child away from the source of danger on the other hand. The Algerian legislator has introduced a new mechanism in handovers measures that did not exist before, which is in handing over a child at risk to a family or trustworthy people in order to take over his care. The subject of the study includes an analysis and critical reading of the entirety of the provisions of Executive Decree No. 19-70 that defines the conditions that must be met by the people and families to whom the task of care will be assigned, and how to organize comparative legislation for this issue, till suggesting new additions to the articles in which the inadequacies appear, or even the omission of organizing a certain matter in order to provide better protection and take into account the privacy of the child in the Algerian Muslim society.
