Résumé: الناظر في السياسات التشريعية الحديثة؛ المحلية منها والدولية، يلحظ أنها اتجهت نحو اتباع استراتيجيات وقائية استباقية، تستهدف حماية الطفل فقط لمجرد كونه في حالة الخطر، وفق رؤية استشرافية تحول دون بلوغه مرحلة الجنوح أو الاعتداء عليه. من هذا المنطلق وجدنا المشرع الجزائري بموجب القانون رقم:15-12 المتعلق بحماية الطفل، أقر آلية مستحدثة لحماية الطفل في خطر، مُؤَمِّلا أن تحول دون ولوجه مرحلة الانحراف أو الجنوح بما لا يليق بالفئة العمرية التي ينتسب إليها، وذلك من خلال منح قاضي الأحداث سواء في مرحلة التحقيق أو الحكم مُكْنَة اتخاذ تدبير بالحراسة؛ المؤقتة أو النهائية، والمتمثل في:" تسليم الطفل في خطر إلى عائلة جديرة بالثقة"، حسب ما ورد في المادتين 35، 40 من هذا القانون على أن تتوافر في العائلة التي تحظى برعاية الطفل في خطر، الشروط التي استوجبها المرسوم التنفيذي رقم:19-70 المؤرخ في:19 فبراير 2019.
