منازعات تسوية البناء غير مطابق لرخصة البناء

Résumé: الملخص: لقد أصدر المشرع الجزائري القانون 08/15 المحدد لقواعد مطابقة البنايات واتمام انجازها كنتيجة حتمية لتطبيق القانون 04/05 المعدل والمتمم للقانون 90/29 المتعلق بالتهيئة والتعمير، وهذا بهدف تسوية وضعية مخالفات في هيئة البناء والتعمير، وبعد العمل بهذا القانون، أصبحت مجموعة المنازعات تظهر على مستوى القضاء، ولذلك سلطنا الضوء على اختصاص القضاء في البت فيها سواء أكان القضاء عاديا متكونا من القاضي الجزائري أو المدني، أو كان القضاء إداريا نتيجة ظهور قرارات متعلقة بلجان تحقيق المطابقة ولاسيما المتعلقة برفض طلب تحقيق المطابقة، ولقد سلطنا الضوء على كيفية معالجة النزاع ابتداء من القانون 04/05 إلى نهاية منازعات التسوية في ظل القانون 08/15. الكلمات المفتاحية: المنازعات، تسوية، البنايات، قانون التعمير، تحقيق، المطابقة. Abstract: Algerian legislator promulgated Law 08/15 establishing the rules for the conformity and completion of buildings as an inevitable result of the implementation of Law 04/05, amending and supplementing Law 90/29 on development and reconstruction. This is in order to resolve the situation of irregularities in the Construction and Reconstruction Authority, and after the application of this judiciary law, disputes appeared at the level of the judiciary, and we have therefore highlighted the jurisdiction of the judiciary to decide it, whether the ordinary judiciary is composed of the Algerian or civil judge or the judiciary was administered as a result of the emergence of decisions concerning conformity commissions, in particular the denial of the application for conformity, We have highlighted how the dispute can be dealt with from Law 04/05 to the end of settlement disputes under Law 08/15.
