ترقية البعد الجمالي للنسيج العمراني في التشريع الجزائري: (الزامية تحقيق مطابقة البنايات على ضوء المرسوم التنفيذي55/22)

Résumé: رغبة من المشرع الجزائري في القضاء على ظاهرة البناء الفوضوي وتسوية وضعية هذه البنايات ،استحدث إجراء تحقيق مطابقة البنايات وإتمام انجازها الذي نص عليه بموجب القانون 15/08المؤرخ في 20جويلية 2008الذي يحدد قواعد مطابقة البنايات وإتمام إنجازه، إلا أنه لم يحقق الأهداف المرجوة منه، حيث ازدادت المخالفات العمرانية ، وانتشرت البنايات غير الشرعية، والتي لا تحترم قواعد التعمير ومعايير البناء. ولضمان رفع العراقيل عملية تسوية هذه البنايات، ارتأى المشرع الجزائري من خلال قانون المالية لعام2017 وضع تدابير قانونية جديدة تهدف إلى تبسيط إجراءات تسوية هذه البنايات، فقام بتاريخ 02 فيفري سنة 2022 بإصدار المرسوم التنفيذي رقم (22/55) الذي يحدد شروط تسوية البنايات غير المطابقة لرخصة البناء المسلمة من أجل سد الثغرات التي طرحها القانون السابق، كل ذلك من أجل ترقية الإطار المبني والارتقاء بالمظهر الجمالي للمدن. Desiring the Algerian legislator to eliminate the phenomenon of chaotic construction and regularize the status of these buildings, a procedure for achieving the conformity of buildings and completing their completion was introduced, which was stipulated by Law 08/15 of July 20, 2008, which defines the rules for matching buildings and completing its completion, but it did not achieve the desired goals, as it increased urban irregularities, and the spread of illegal buildings ,Which does not respect the rules of reconstruction and building standards. In order to ensure that the obstacles to the settlement of these buildings are lifted, the Algerian legislator decided, through the Finance Act of 2017, to put in place new legal measures aimed at simplifying the procedures for the settlement of these buildings. So, on February 02, 2022, he issued Executive Decree No. (22/55) that defines the conditions for the settlement of non-conforming buildings. The building permit issued in order to fill the gaps raised by the previous law, all in order to upgrade the built framework and improve the aesthetic appearance of cities.
