المكانة القانونية لليمين الدستورية _دراسة مقارنة بين النظام الدستوري الجزائري و الأنظمة الدستورية المقارنة

Résumé: يتمثل موضوع الدراسة في المكانة القانونية لليمين الدستورية دراسة مقارنة بين النظام الدستوري الجزائري و أنظمة دستورية مقارنة، بناء على إشكالية مفادها: هل تتبوؤ اليمين الدستورية في النظام الدستوري الجزائري المكانة ذاتها التي تتمتع بها في الأنظمة الدستورية المقارنة ؟ و قد تطرقت هذه الدراسة إلى تحليل و مقارنة الأحكام القانونية المتعلقة باليمين الدستورية في كل الدساتير الجزائرية ابتداء من دستور سنة 1963 إلى التعديل الدستوري لسنة 2016 و دساتير أخرى مختلفة تم اختيارها بناء على أهمية الأحكام القانونية فيها، لتتوصل هذه الدراسة إلى أن المكانة القانونية لليمين الدستورية في النظام الدستوري الجزائري تعد في مرتبة متوسطة الأهمية مقارنة بمكانتها في دساتير دول أخرى التي أعطتها أهمية بالغة و فصلت في الأحكام المتعلقة بها و الآثار المترتبة عنها. Abstract: The subject of the study is the legal status of the constitutional oath, a comparative study between the Algerian constitutional system and comparative constitutional systems, based on the problem of: Does the constitutional oath occupy the same position in the Algerian constitutional system as it enjoys in the comparative constitutional systems? And a comparison of the legal provisions related to the constitutional oath in all Algerian constitutions, starting from the constitution of 1963 to the constitutional amendment of 2016, and various other constitutions that were chosen based on the importance of the legal provisions therein. This study concludes that the legal position of the constitutional oath in the Algerian constitutional system is of medium importance compared to its place in the constitutions of other countries, which gave it great importance and detailed the provisions related to it and the implications for it.
