حق المستهلك في الضمان

Résumé: إن اتسام القواعد العامة بالقصور وعجزها عن توفير حماية كافية للمستهلك، مكن المشرع من المبادرة لسن قواعد خاصة تكفل حق الضمان للمستهلك بصفة قانونية، من خلال قانون حماية المستهلك وقمع الغش، الذي كرس مجموعة من الآليات الفعالة التي يراد من خلالها تعزيز هذا الحق، و تحقيق التوازن بين طرفي العلاقة الاستهلاكية. كما أن إقرار الضمان الإضافي، الذي يحتوي على إعمال ضمانات زائدة قررت لصالح المستهلك، منح لهذا الأخير فرصة مطالبة المتدخل بتنفيذ التزاماته في فترة الضمان بالرغم من تجربته للمنتوج. بالإضافة إلى أن القواعد الخاصة تبنت مبدأ مساءلة جميع متداولي المنتوج، بصرف النظر عن المتعاقد المباشر مع المقتني . وفضلاعلى هذا فقد ساهمت ترسانة القوانين و الأنظمة المستحدثة من إمكانية المطالبة بالتعويضات التي نشأت بموجب إصلاح عيب في المنتوج ، بل و أطرت حق المستهلك في الرجوع على المتدخل، في حال تحمل المستهلك عبء الخدمة على نفقته. ولبعث الطمأنينة في التعاقد بمنح الثقة في المنتج، والحرص على استقرار المعاملات في مثل هذا النوع من العقود ، عززت حماية المستهلك بميزة أخرى وهي خدمة ما بعد البيع، التي ترافق استغلال المنتوج من خلال تفقده بالصيانة من حين للآخر من طرف المتدخل. ومنه نستنتج أن المستهلك حظي بحماية جدية و فعالة شملت جميع مراحل اقتنائه للمنتوج.
