Résumé: ملخص : يوفر إستخدام البطاقات الإئتمانية مزايا جمة لفائدة الحامل الشرعي للبطاقة(العميل)، وكذا جهة الإصدار (البنوك)، بالإضافة إلى التجار الذين يقبلون التعامل بها، وهذا متى إلتزم أطراف هذه العلاقة الثلاثية العمل بنظام البطاقة وفق الشروط المحددة لذلك، لكن وبالرغم من وجود عقد بين العميل والبنك يحدد حقوق والتزامات طرفي العقد، إلا أنه قد يعمد العميل إلى مسالك ملتوية في إستخدام البطاقة بمعنى أنه يخرج العميل من المسار الصحيح لاستعمال البطاقة إلى مسالك أخرى مخالفة للبنود الواردة في العقد الممضي بينه وبين جهة الإصدار، حيث ينجم عن الإستخدام غير السليم للبطاقة الإئتمانية خسائر كبيرة، وبالتالي بات من الضروري إيجاد آليات تضبط حالات إستعمال العميل للبطاقة بطرق منافية للقانون. الكلمات المفتاحية: المسئولية الجزائية، الإستعمال غير القانوني، البطاقة الإئتمانية، الحامل الشرعي.
