Résumé: مرت ممتلكات الجماعات المحلية بمراحل مختلفة متأثرة بالاتجاهات السياسية والاقتصادية، فلم يعترف المشرع الجزائري بوجود أملاك خاصة بها إلا بظهور قانون الأملاك الوطنية سنة 1990، حيث قام بتصنيف هذه الأملاك إلى عامة لا يجوز التصرف فيها بأي نوع من أنواع التصرفات القانونية أو الحجز عليها أو تملكها بالتقادم، وأملاك خاصة أخضعها للقانون الخاص في عمليات التصرف فيها. ونظرا للأهمية الكبرى التي تحتلها فلا يمكن بأي حال من الأحوال أن تكون وسيلة ناجعة دون جهاز إداري محكم وفعال تخضع له ونظام قانوني من شأنه توفير أكبر قدر من الحماية.
