دور التكييف في تحديد طبيعة الدعوى وأثره على تسبيب الأحكام القضائية

Résumé: تمر كل دعوى قضائية بمجموعة من المراحل التي حددتها مسبقا القواعد الإجرائية والموضوعية، ويتلخص العمل القضائي في هذه المراحل في مسألتين في غاية الأهمية أولهما التكييف القانوني والذي يمثل همزة الوصل بين الواقع والقانون، إضافة إلى تسبيب الحكم القضائي ، وتهدف هذه الورقة البحثية إلى إبراز دور التكييف في تحديد طبيعة الدعوى وأثره على تسبيب الأحكام القضائية. Every judicial case goes through a set of stages that are predetermined by procedural and substantive rules. Judicial work in these stages is summed up in two very important issues, the first of which is legal adaptation, which represents the link between reality and the law, in addition to the reasoning for the judicial ruling. This research paper aims to highlight the role of adaptation. In determining the nature of the case and its impact on the causation of judicial rulings.
