تفعيل المقاصد الشرعية في التكييف الفقهي للوقائع المستجدة - بعض المسائل في الأحوال الشخصية نموذجا-

Résumé: ملخــــص التكييف الفقهي باعتبـاره أسـلوب عملي من أساليب الاجتـهاد الفقهي للحـكم على الوقائع والقضايا المستـجدة ؛ فلا يصار إليه إلا بعد التحقق من توافر مقوماته وعناصره الأساسية ، والتي تقوم أساسا على لزوم مراعاة مقاصد الشريعة بموجب أن الأحكام والوسائل التشريعية المعالجة للوقائع والمشكلات، وضعت ابتداء لتجسيــدها على أرض الواقع ، وهذا الأمر يقتضي التقيد بقواعـــدها وكليــــاتها عند التنزيل ، لذا تهـــدف هذه الدراســـــة إلى الكشف عن تفعيـــلها في ممارسة التكييف الفقهي لمجابهة تحديات العصر وبيان دورها في معـــالجة مشكلاته بنماذج تطبيقية. Summary The jurisprudence adapting as a practical style of the jurisprudence effort to judge the facts and emerging issues; not using it only after verifying the availability of its components and basic elements, which are based mainly on the necessity of taking into the account the purposes of the Sharia, because the legislative provisions and the jurisprudence rule treating the facts and problems have been setting firstly to practice it in the real world; therefore, this issue is based according to its principles and aggregates in the practical stage. Therefore, the aim of this study is to detect how to activate the purposes of Sharia to practice the jurisprudence adapting to meet the present aria challenges, and explaining its role to treat the problems according to practical examples.
