نحو تأسيس قانون دولي لحماية التراث الثقافي

Résumé: الملخص: ترمي هذه الدراسة الى طرح فكرة تأسيس فرع جديد من فروع القانون الدولي العام يُعنى بحماية التراث الثقافي، وهذا لما تحتويه هذه الكنوز الثقافية من أهمية متعاظمة وفي جميع المجالات الثقافية، التاريخية، الاجتماعية، السياحية، الاقتصادية...الخ. حيث تم التركيز على تبيان أهم الركائز التي يمكن الاستناد عليها في تأسيس هذا الفرع، كالمصادر التي يُحتكم إليها من اجل حمايته دوليا وداخليا، وأهم المؤسسات الدولية التي تُعنى هي الأخرى بحمايته والحفاظ عليه وتثمينه، ومختلف أنظمة الحماية المقررة للحفاظ عليه خاصة زمن النزاعات المسلحة. Abstract: This study aims to put forward the idea of establishing a new branch of public international law to protect cultural heritage, because of the growing importance of these cultural treasures and in all cultural, historical, social, tourism and economic fields... etc. The focus has been on identifying the most important pillars on which to base the establishment of this branch, such as the sources it needs to protect internationally and internally, the most important international institutions that are also concerned with protecting, preserving and valuing it, and the various protection systems established to preserve it, especially in the time of armed conflict.
