المسؤولية الجنائية الدولية والفردية عن الانتهاكات الواقعة على التراث الثقافي International And Individual Criminal Responsibility For Violations Of Cultural Heritage

Résumé: ملخص: لضمان فعالية القواعد القانونية الدولية المقررة لحماية التراث الثقافي من الانتهاكات ، تقرر وضع المسؤولية على الصعيد الدولي ذات طبيعة مزدوجة تشمل كل من الدولة وكذا الأشخاص الذين يقومون بالاعتداء على الأعيان الثقافية ، على اعتبار أن تلك المسؤولية ليست مقتصرة على الدول فقط التي تكون ملزمة برد الممتلكات الثقافية التي تحصلت عليها في النزاعات المسلحة أو أثناء الاحتلال مع دفع تعويضات للدول المتضررة ، بل تتسع لتشمل الأشخاص الطبيعية ، خاصة وأنه في كثير من الأحيان يقوم الفرد بالتعدي على التراث الثقافي بعدة طرق مما يعني ضرورة المساءلة الجنائية الدولية للفرد . لهذا الإشكالية الأساسية هنا تعلقت بمدى كفالة الاتفاقيات الدولية للمسؤولية الجنائية الدولية والفردية بشأن الانتهاكات الواقعة على التراث الثقافي ؟ إذ رغم كل العناية المكفولة للتراث الثقافي إلا أنه لازالت الدول المتحاربة إلى يومنا هذا تقوم بتدمير هذه الآثار والمباني التاريخية والتهرب من المسؤولية بحجة الضرورة العسكرية التي على أساسها تم هدر الهوية الثقافية للدولة المحتلة. Abstract: In order to ensure the effectiveness of established international legal standards for the protection of cultural heritage against violations, it was decided to impose a dual responsibility, this responsibility not being limited only to States required to return cultural property. That were acquired in armed conflict or during the occupation with compensation of affected countries, but which can extend to natural persons, especially since the individual often breaks the cultural heritage in several ways, the fundamental problem here was the degree of guarantee of international conventions on international and individual criminal responsibility for violations of cultural heritage. In spite of all the care given to the cultural heritage, the warring countries continue to this day to destroy these monuments and historic buildings and escape all responsibility under the pretext of military necessity on the basis of which the cultural identity of the occupied State has been destroyed.
