Résumé: يتميز النظام القانوني لمسيري المؤسسات العمومية الإقتصادية ، و المتمثل خصوصا في المرسوم التنفيذي رقم 90-290 ، المتعلق بالنظام الخاص بعلاقات العمل الخاصة بمسيري المؤسسات ، في بعض قواعده القانونية كونها غير مألوفة في نظام علاقات العمل العادية ، لأنه يرتكز بالأساس على إجراءات التوظيف وكذا إلى طبيعة العقود التي تتميز بها عن غيرها من عقود العمل العادية بالإظافة إلى الصفة المزدوجة التي يحملها هؤلاء المسيرين ، فهي صفة الأجراء من جهة و من جهة أخرى صفة الوكلاء عن المؤسسات التي يعملون لحسابها،كذلك الطبيعة الخاصة التي تتعلق بمضمون العقد و إجراءات إبرامه و أخيرا في الأحكام و القواعد القانونية التي تحكم علاقات عملهم مع المؤسسة و المتمثلة في قانون العمل 90-11 و القانون التجاري.
