الخبرة الطبيــة كآلية داخلية لتسوية المنازعات الطبيـــة في مجال الضمان الاجتماع

Résumé: لقد خص المشرع الجزائري المؤمنين اجتماعيا بحماية خاصة، من خلال النصوص القانونية التي جاء بها تشريع الضمان الاجتماعي، فأجاز لهم حق الطعن في جميع القرارات الصادرة عن هيئات الضمان الاجتماعي، ومن بينها القرارات الطبية التي تصدر عن الطبيب المستشار التابع لصندوق الضمان الاجتماعي، والتي تكون سببا في نشوء المنازعة الطبية. كما حاول من خلال التعديلات المختلفة لقوانين منازعات الضمان الاجتماعي تنظيم آليات تسوية هذه الخلافات بما يخدم مصلحة المؤمن له ويخفف عنه الأعباء والتكاليف، فجعل من التسوية الداخلية لمنازعات الضمان الاجتماعي الأصل، وذلك إما عن طريق اللجوء إلى الخبرة الطبية، أو الاعتراض أمام لجنة العجز الولائية إذا تعلق الأمر بحالة من حالات العجز. The Algerian legislator has granted social security beneficiaries special protection through the legal texts established by social security legislation. It has allowed them the right to appeal all decisions issued by social security bodies, including medical decisions made by the consulting physician affiliated with the social security fund, which can lead to medical disputes. Additionally, through various amendments to the laws governing social security disputes, efforts have been made to organize mechanisms for resolving these conflicts in a manner that serves the interests of the insured and alleviates their burdens and costs. It has established internal resolution of social security disputes as the norm, either by resorting to medical expertise or by appealing to the provincial disability committee in cases of disability.
