"آليات التسوية الادارية للمنازعات الطبية في مجال الضمان الاجتماعي " - الخبرة الطبية نموذجا –

Résumé: يقصد بالمنازعات الطبية في مجال الضمان الاجتماعي، الخلافات المتعلقة بالحالة الصحية للمستفيدين من الضمان الاجتماعي لاسيما المرض و القدرة على العمل و الحالة الصحية للمريض و التشخيص وكذا كل الوصفات الطبية الأخرى ، حيث اعتبر المشرع الخبرة الطبية كآلية من آليات التسوية الإدارية لهذا النزاع ليكون اللجوء إليها بمثابة تحكيم طبي وكإجراء أولي وجوبي لتسوية النزاع الطبي داخليا لابد على المؤمن له اجتماعيا اي المريض احترام هذا الإجراء الذي يعتبر من النظام العام قبل اللجوء أمام الهيئات القضائية المختصة للفصل في النزاع ، كما تجدر الاشارة أن جميع المنازعات الطبية تخضع لإجراء الخبرة الطبية ماعدا المنازعات الطبية المتعلقة بحالات العجز الذي تكون من اختصاص لجنة العجز المؤهلة . Abstract Medical disputes in the field of social security are concerned with differences concerning the health status of beneficiaries of social security, especially illness, work capacity, patient health, diagnosis and all other prescriptions. The legislator considered medical expertise as a mechanism for administrative settlement of this dispute, Medical arbitration as a preliminary and objective measure for the settlement of the internal medical dispute; the insured person must respect the procedure which is considered by the public order before resorting to the competent judicial bodies to resolve the dispute. It should also be noted that all the disputes Medical is subject to medical expertise except medical disputes relating to cases of disability, which will be the competency of the eligible deficit.
