الاختصاص القاعدي للسلطات الإدارية المستقلة The Normative Competence Of Independent Administrative Authorities

Résumé: إن فكرة الاختصاص القاعدي للسلطات الإدارية المستقلة مرتبطة أساسا بمبدأ تدرج القواعد القانونية في الدولة، وبدور السلطة الإدارية بصورة عامة والسلطات الإدارية المستقلة بصفة خاصة في إنتاج هذه القواعد القانونية. ومن ثم فما هي صور هذا الاختصاص بالنسبة للسلطات الإدارية المستقلة وما مدى موافقتها للدستور؟ إن السلطات الإدارية المستقلة، وإن كانت تتمتع بخاصية إصدار القرارات الفردية كمظهر من مظاهر امتيازات السلطة العامة - على غرار الهيئات الإدارية التقليدية، إلا أنه وبالعكس من ذلك لا تتمتع كل هذه الهيئات بالسلطة التنظيمية. فمنها من يحوز على سلطة تنظيمية حقيقة وإن كانت تبعية أو تطبيقية ومنها ما تملك سلطة تنظيم غير مباشرة تظهر في شكل التعليمات والاقتراحات والتوصيات. The idea of the normative competence of independent administrative authorities is basically linked to the principle of gradation of legal rules in the state, And the role of the administrative authority in general and the independent administrative authorities in particular in producing these legal rules. Then, what are the forms of this competence for the independent administrative authorities, and to what extent do they agree with the constitution? The independent administrative authorities, although they have the feature of issuing individual decisions as a manifestation of the prerogatives of the public authority, conversely, not all of these bodies have regulatory power. Some of them have real regulatory authority, even if they are affiliated or applied, and some have indirect regulatory authority that appears in the form of instructions, suggestions and recommendations
